Terms of Service
These Terms govern use of the Marketing Team HQ website, trial application, seven-day marketing trial and recurring marketing services. By starting a trial or purchasing services, the client confirms that an authorised representative has read and accepted these Terms and the linked policies.

1Who may use the services
The website and services are offered to businesses and their authorised adult representatives. A person accepting these Terms for a business confirms that they have authority to bind that business. Paid growth applicants should have an existing product or service that customers already buy, sufficient operational capacity and the financial ability to pay advertising and third-party costs separately. Brand Presence may be selected by creators or businesses seeking organic social activity without paid advertising.
2Applications and qualification
The client must provide accurate and current application, contact and billing information. Submission of an application does not guarantee that every requested service, channel or activity is suitable. Marketing Team HQ may recommend a different scope, decline unlawful or high-risk work, or require additional information or access before work begins.
3Seven-day trial and automatic start
- The client selects a plan, completes the application and enters a payment method through Stripe Checkout.
- No subscription fee is charged when the trial begins. Separate third-party costs are incurred only when expressly approved.
- The exact trial activities depend on the selected plan, available access, tracking readiness and information provided by the client.
- Unless the subscription is cancelled before the trial ends, Stripe automatically charges the selected monthly plan after seven days and recurring paid service begins.
- Cancelling during the trial prevents the first monthly subscription charge but does not reverse separately approved third-party costs.
4Plans, scope and changes
The selected pricing page, proposal, order form or written scope describes included deliverables. Monthly quantities are capacity limits for the relevant service period and do not roll over unless agreed in writing. A request outside the agreed scope may require a revised plan, separate quote or additional fee. Marketing Team HQ may make reasonable operational changes that do not materially reduce the purchased service.
5Client responsibilities
- Provide accurate information, timely access, feedback, approvals and materials required for the work.
- Maintain ownership or valid permission for supplied trademarks, footage, images, lists, claims, testimonials and other materials.
- Review deliverables and notify the agency promptly of factual, regulatory or brand concerns.
- Maintain sufficient inventory, staffing, fulfilment, sales capacity and advertising budget for the chosen activities.
- Comply with platform rules, advertising laws, privacy requirements and industry-specific obligations applicable to the client’s business.
6Fees and third-party costs
Subscription fees are charged monthly in advance through Stripe. Advertising spend, creator fees, product samples, professional filming, paid software, taxes and major website development are separate unless expressly included in writing. The client remains responsible for charges billed directly by Meta, Google, TikTok or another provider.
7Cancellation, refunds and failed payments
The Refund Policy, Cancellation Policy and Failed Payment Policy form part of these Terms. The client should review them before starting the trial. If a provision conflicts with a signed service agreement or order form, the signed document controls for that specific engagement, subject to applicable law.
8Marketing performance
Marketing performance depends on the offer, pricing, competition, demand, website, tracking, sales process, advertising budget, platform decisions and other factors outside Marketing Team HQ’s control. Forecasts, examples, audits and case studies are informational and are not promises of future performance.
9Intellectual property
Each party retains ownership of materials it owned before the engagement. After all applicable invoices are paid, the client may use final approved deliverables created specifically for the client within the rights described in the applicable agreement. Marketing Team HQ retains its pre-existing methods, templates, processes, know-how and internal working files. Third-party fonts, stock assets, software and platform materials remain subject to their own licences.
10Third-party services
The website and services may rely on third parties including Stripe, Supabase, hosting providers and advertising platforms. Marketing Team HQ does not control their availability, policies, reviews, account restrictions, algorithms or outages and is not responsible for their independent acts or omissions, except where applicable law provides otherwise.
11Acceptable use
The website and services must not be used for unlawful, deceptive, abusive, infringing or harmful activity; unauthorised access; distribution of malicious code; or misrepresentation of identity, authority, products or results. Marketing Team HQ may suspend affected work while investigating a credible legal, security or platform risk.
12Confidentiality
Each party should protect non-public business, customer, access and performance information received from the other and use it only for the engagement. This obligation does not apply to information that is public through no breach, already lawfully known, independently developed or required to be disclosed by law.
13Disclaimers and liability
Services are provided with reasonable care and skill, but the website, third-party platforms and marketing outcomes cannot be guaranteed to be uninterrupted, error-free or successful. To the extent permitted by applicable law, neither party will be liable for indirect, incidental, special or consequential loss arising from the website or services. Nothing in these Terms excludes a liability that cannot lawfully be excluded.
14Suspension and termination
Marketing Team HQ may pause or end services for nonpayment, unlawful activity, abusive conduct, material breach, repeated failure to provide necessary access or work that creates significant platform or reputational risk. Financial treatment and handover obligations will follow the signed agreement and linked policies.
15Changes, applicable law and contact
These Terms may be updated when services, billing processes or legal requirements change. The terms accepted at purchase continue to apply to that transaction unless a lawful update is communicated. Applicable law and any signed agreement determine the governing rules and available dispute process.
